Key Responsibilities

NPA Resolution

  • Assess NPA accounts and decide the recovery route.
  • Take physical possession of properties under SARFAESI guidelines.
  • Plan and execute asset sales to recover dues.

Legal Action

  • Issue statutory notices like SARFAESI 13(2) notices and Section 101 final notices to borrowers/guarantors.
  • Handle objections and take cases to possession/foreclosure stage.
  • File cases before DRT (Debt Recovery Tribunal) and NCLT (National Company Law Tribunal).
  • Draft and vet legal documents and ensure legal compliance.

Strategy & Compliance

  • Create collection strategies aligned with company goals.
  • Ensure compliance with RBI prudential guidelines for ARCs.
  • Prepare recovery-related drafts under relevant Acts (SARFAESI, IBC, etc.).

Stakeholder & Department Coordination

  • Maintain a strong network with various government and regulatory departments.
  • Coordinate with internal teams for recoveries, collections, and legal follow-up.

Skills & Experience Needed

Education: LLB / LLM

Experience: 810 years in ARC, Banking, NBFC, or Financial Institutions handling NPA cases.

Technical Skills:

  • SARFAESI, IBC, NCLT legal procedures.
  • Litigation handling & asset sale processes via DRT.
  • Strong MS Office and Excel skills.

Behavioral Skills:

  • Negotiation & conflict resolution.
  • Eye for detail, leadership qualities, flexibility.
