Sandvik Mining and Rock Solutions is a business area within the Sandvik Group and a leading global supplier of equipment, tools, services, and technical solutions for the mining industry. The product offering covers rock drilling, rock cutting, rock crushing, loading and hauling and materials handling, battery-operated vehicles and Sandvik’s market-leading automation and electrification offerings.
Legal & Compliance Officer is responsible for enabling support and sustain an effective compliance program for the business unit across the SMR Compliance programs, enabling business in accordance with the Sandvik Way. This requires demonstrating leadership and best practice to management and within the sales area through training and regular communication. SMR Compliance Operating Model aims to decentralize compliance into the local business unit, ensuring accountability closest to the customer, the risk and built into the process of the relevant function. We are now looking for a confident and proven professional to take on the position as Legal & Compliance Officer - a versatile position where you get to balance your dedication to legal and business compliance with your business-driven mind, in a truly global setting.
Your mission - To facilitate business unit compliance with the Sandvik Way policies, and SMR procedures, laws, and regulations governing the business in relation to Anti-bribery and Corruption (ABC), Competition Law, Trade Compliance, Data Privacy and Enterprise risk management coordination and provide all required legal support in Legal advisory, Litigation, legal documentation.
As a Legal & Compliance Officer, you are responsible for- Demonstrates EHS awareness for self and others with relevant actions
- Point of contact for the SMR Global Compliance network and for the Risk Territory.
- Support the regional/ local management teams in all compliance matters.
- Focus on efficiently delivering/ participating in local ABC training sessions.
- Focus on supporting and oversighting India based investigations (whistleblowing) in accordance with the Speak Up system and the Speak Up Policy.
- Screening: Accountable for Screening Commercial Intermediaries in the region of responsibility, new and legacy.
- Making recommendations in Due diligence reviews to local and regional business line managers,
- Phase 2 review of CI Procedure
- CI reviews
- Ensuring quality in reporting of required compliance KPI metrics on a quarterly basis or as advised from time to time.
- Support, advice and monitor of risk mitigation and remediation activities arising out of investigations.
- Data Privacy laws implementation and trainings. Ensure compliance as required under GDPR and Local Privacy Laws.
- Competition law understanding, its compliance implementation and trainings.
- Monitoring and supporting Litigation of the Company.
- Reviewing, drafting legal documents including contract negotiations.
- Legal support to all functions of SMRTIPL.
Compliance support activities would also include:
- Participating in Enterprise Risk Management risk assessments and advise regional management and other levels of management of potential compliance risk areas and recommend appropriate action plans;
- Perform regular compliance monitoring of identified high risk activities and provide reports to Legal/ BA Compliance Director as requested;
- Works cross functionally with business integrity in resolving individual compliance issues/questions, developing corrective actions and ensuring consistent discipline.
- Shares best practices across the Sales Area and territories under management.
- Pro-actively raise awareness and communicate about SMR compliance in the business unit in a business-relevant manner, e.g. by training of new employees and continuous training in compliance, key policies and procedures within the risk areas defined.
- Conduct trainings in close collaboration with regional management
- Help ensure key compliance records (incl. third party records, training records) are well-organized and stored, e.g. that policies and procedures are stored adequately, easily accessible and clearly communicated to all employees, and monitoring findings and reports are maintained
- Support communications within the sales are to set 'tone from the top' and 'tone from every level'.
- Deploy KPIs around metrics tracked for training, communications, third parties due diligence, “Gift, Entertainment and Travel” and other metrics as defined for reporting to SMR management
- Implement remediation activities as instructed.
- Review compliance capability and effectiveness on a periodic basis (at least annually) and plan improvement
The function, through a risk-based approach, helps embed in an effective and efficient manner, business integrity and compliance behaviours into sales area operations at all levels and locations. The position leads the SMR’s efforts to facilitate compliance with policies and procedures, laws, and regulations
