QUICK VERIFICATION REPORT

Subject: Allegation against Waqf Board Chief Executive Officer Shri. B.M. Jamal - in relation to conducting quick verification and submission of report

Notice: CMP-2222/2016/ECM of EC & SJ, Muvattupuzha dtd:14/12/2016

I. INTRODUCTION:
On the basis of allegations leveled against Waqf Board Chief Executive Officer Shri. B.M. Jamal by a complaint made by Shri. Abdul Salaam T.M., Thaikattathil House, Trikkakkara P.O., Kochi - 21, the Hon’ble Muvattupuzha Vigilance Court had vide the abovementioned notice directed the Ernakulam V.A.C.B. Unit received through the Dy.S.P and the same being redirected to me the same is being investigated and the report is being submitted.

II. SYNOPSIS OF THE ALLEGATIONS:
1. Waqf properties worth Rupees 2 Lakh Crores illegally misappropriated

2. Saleema, Subaida and M. K. Jaafar were provided appointments illegally; vide Order No.5465/11 dated 09/04/2013 C. A. Madaiah, a contractual employee, was made permanent with retrospective effect; by appointing 5 people a loss of Rs.8,04,859 was incurred to the Waqf Board.

3. Employees appointed on contract basis through employment exchange being allowed to continue illegally, LDC post needs PGDCA also, however said appointments were made without the requisite qualification, when the Government recognized the permanency of employees appointed through employment exchange and in continuous service for 7 years, employment being conducted through backdoor, employees appointed legally mentioned as not having completed 7 years of service, Anas Benhar, M.K. Junaid, M. Saajid, N.A. Sabeena not having completed 7 years of service but Chief Executive Officer had written letter recommending their permanency, only 4 out of 13 employees recommended for permanency had completed 7 years of service, 10 did not have the requisite education qualifications.

4. Ahammed Kabir’s wife Mumtaz was appointed as CEO’s Clerk vide proceedings No.C4-1647/200-1 dated 17/05/2014, while others being appointed through Employment Exchange Mumtaz was recruited directly; Mesagalin at Kozhikode Office, P.D. Fousiya at Kannur Office, M.A. Ali at Malappuram Office were illegally appointed as Clerical Assistant; person working as driver was appointed as Clerk at Thiruvananthapuram Office.

5. Hafsat was appointed as Legal Advisor though having crossed the age limit; vide Orders No.B6-847 & 848/2009 dated 06/02/2016 without intimation to the Board was appointed at Manjeri, vide order No.B6-1924/16 dated 29/04/2016 Sharafuddin Habeeba Moosa were appointed despite Code of conduct being in force.

6. According to 2003 Waqf Regulation there being no post in existence for Finance Officer, Mohammed Rafi, a retired Officer was appointed as Finance Officer, without the acceptance of the Board CEO ordered Shri. Mohammed Rafi’s consolidated pay to be increased to Rs.42,806/-, thereafter without possessing requisite qualification Shri. Mohammed Rafi was appointed as Administrative-cum-Finance Officer vide Order No.B6-2553/13 dated 10/02/16, huge amount of losses incurred through salary paid to Shri. Mohammed Rafi for 6 years.

7. Employees whose term of service had expired were allowed to continue in their posts to set in force Centralized computing facility scheme, term of service of T.M. Masood having expired he was allowed to continue as staff of the Board and appointed as Assistant Developer.

8. According to the Rules only Muslims are entitled to appointment, however contrary to these Rules non-Muslims Kartiyayini Raveendran, Valsa Varghese, Antony were appointed at Ernakulam Office, Reena Vincent at Kozhikode, Valsala at Thiruvananthapuram was appointed as Last Grade.

9. Jabbar Kunju not having the requisite degree was appointed as Executive Officer at Changanashery Puthur Mosque and Chnaganashery Old Mosque, his term was extended without the acknowledgement of the Board, his salary was also increased, non degree holders K.K. Mohamed, K.C. Mohammed Koya were also appointed as Executive Officers.

10. Retired K.K. Mohammed, T.A. Abdul Basheer vide order No.B6-6790/15 dated 15/12/15 were appointed, according to service rules pension amount was to be deducted from their salary however, the pension amounts were not deducted from the salaries of K.K. Mohammed and T.A. Abdul Basheer, T.A. Abdul Basheer was since 12 years appointed as Observer at Vavar Mospue and for each travel was allowed Rs.3000/-, by Order No.E7-1555/14/KTM dated 27/11/14 term of T.A. Abdul Basheer was extended without the acknowledgement of the Board, according to Section 63 of Waqf Rules appointment of the Elderly was with the Waqf Board, however without the knowledge of the Board Fousiya Mustafa was appointed as interim Elderly at Karaat Mosque.
