1 Litigation- Handling litigations for the Company in various Courts/Forums including Labour Courts, Industrial Courts,- Small cause courts, Magistrate Court, District and Session Courts, High Courts etc PAN India.- Handling Arbitration proceedings and proceedings before the High Court arising out of such Arbitrations,- briefing and assisting the external Counsels in the ongoing Arbitration proceedings.-
- Drafting reply to legal notices, regulatory notices, active/inactive employees, third party association or- Labour union representations etc.- Assessment and evaluation of risk arising out of pending litigation cases.- General advisory to internal / external stakeholders on ongoing litigations, litigations strategy, evidence collection guidance and support to stakeholders, briefing to witnesses.- Legal Research on issues / challenges faced.- 2 Employment Matters- Handling Labour/Employment Litigations across India raised under Industrial Disputes Act and other labour laws, succession matters, family dispute matters.- Advise to internal stakeholders on Policy matters, IR/ER issues, compliance matters related Contract Labour (Regulation & Abolition) Act, Social Security and other benefits administration, Court notices, witness summons etc.- Discipline Management: Drafting / review of show cause notice, charge-sheet, Termination / Discharge / Dismissal Order under Industrial Employment Standing Order or Service Rules of the Company and other miscellaneous disciplinary documents.- Handling the litigations or disputes raised under Industrial Disputes Act or Unfair Labour Practices- Global mobility / deployment documents review and legal support for mobility challenges, cross border employment litigations etc.- 3 Vendor Contracts- Responsible for independent handling, drafting and reviewing Master Service Agreement, Statement of- Work, Service Level Agreement, MOU and other vendor contract agreements (Supply of Goods and Services Agreement, Facilities Management Agreement, Attornment Deeds, Bank Guarantees, Employment- Contracts, Subscription Agreement, Event Sponsorship Agreement, Various Service Agreements,- Consultancy Services Agreement, Licensing Agreement, Corporate Tie Up Agreements, CSR Agreements,- Lease Financing Agreement, Master Rate Contracts, Notice of Termination, etc.)- 4 Management Reporting / Audits- Preparing Litigation Reports for senior management and external auditors- Handling Audit queries regarding litigations- Obtaining independent evaluation from external Counsels on all pending Litigations- 5 Data Privacy Laws- Basic Knowledge on Data Privacy and Data Protection Laws prevailing globally.- Reviewing Data Processing Agreements or Data Transfer Agreements- Sound understanding of the compliance obligations of Controller and Processor, Standard Contractual Clauses obligations, modules, applicability and enforcement
