Job Title: Claims and Legal Expert

This is an exciting opportunity for a seasoned professional to join our team as a Claims and Legal Expert. In this role, you will be responsible for handling all legal matters related to claims, including monitoring and managing court cases, appeals, and writ petitions initiated by authorities such as Customs, DRI, SIIB, and CBEC.

The ideal candidate will have a minimum of 5+ years of experience in the shipping industry, preferably with cargo or marine claims experience. They will also possess excellent written and verbal communication skills, good analytical skills, and proficiency in MS Office tools, especially Excel and PowerPoint.

  • Main Responsibilities:
  • Monitor and handle all legal issues related to claims matters.
  • Handle all sorts of recovery actions, including outstanding freight, detention, and demurrage, abandoned and longstanding containers.
  • Monitor and assist Head Office claims and other colleagues in handling of claims and court cases until closure.
  • Monitor and handle all P&I related matters, such as cargo claims, GA & stowage, etc.
  • Handle all third-party damages to CMA CGM containers and cargo, including stevedore damages.
  • Handle Debt Recoveries in accordance with NCLT tribunal.
  • Drafting and vetting various Service Agreements and drafting various MOU, Letters of Intent, agreements, etc.
  • Ensure that all procedures implemented by the Head Office Legal Department are duly implemented and followed within the network.
  • Key Performance Indicators:
  • Monitor and handle court cases, appeals, writ petitions, and actions initiated by authorities.
  • Appoint and liaison with reputable surveyors and outside counsels, negotiating reasonable expenses.
  • Recommend improvements to the claims handling process and procedures.
  • Monitor and report on Indian case law and regulations impacting CMA CGM's scope of activity.

Requirements:

  • Minimum graduate degree.
  • Excellent written and verbal communication skills.
  • Good analytical skills, reporting skills, and proficiency in MS Office tools, especially Excel and PowerPoint.
