Role & responsibilities

I. Litigation & Court Representation (Performance & Competence)

  • Case Strategy and Management: Develop and execute practical legal solutions and robust litigation strategies to best protect and enhance the genuine interest of clients.
  • Pleadings and Drafting: Draft, vet, and finalize a wide range of legal documents, including plaints, written statements, recovery suits, petitions (including Writ Petitions under Articles 226 & 227 , and appeals), and applications across all areas of practice.
  • Court Appearances: Represent the firm's clients before all relevant forums, including the Hon'ble Supreme Court, Hon'ble High Courts, District Courts, and various Tribunals such as DRT/DRAT, NCLT/NCLAT, and CESTAT/GSTAT.
  • Procedural Compliance (Criminal Law): Handle all stages of criminal procedure under the Bharatiya Nagarik Suraksha Sanhita (BNSS), including Pre-FIR/FIR stage, investigation, bail/anticipatory bail applications (Secs BNSS), and conducting trials under the BSA, 2023 (modernised law of evidence).

II. Expertise in Core Practice Areas (Competence)

The Advocate is expected to manage matters effectively in at least two of the following specialized areas:

  • Civil & Commercial Disputes: Handle complex matters involving Commercial & Contractual Litigation, Property & Real Estate Disputes (e.g., title, eviction, specific performance), and matters before Commercial Courts.
  • Financial & Insolvency: Manage cases under the SARFAESI Act, RDDBFI Act, and the Insolvency and Bankruptcy Code (IBC) for corporate insolvency and personal guarantor matters.
  • Criminal & Economic Offences: Prosecute and defend cases involving White Collar & Economic Offences (e.g., Cheating, Criminal Breach of Trust, Money Laundering, Corruption) and Financial Crimes (e.g., Dishonour of Cheques).
  • Indirect Tax: Handle litigation for GST (SCN, ITC disputes, Refund claims, Anti-profiteering), Customs (Classification, Valuation, Confiscation), and legacy Central Excise & Service Tax issues.

III. Professional Development & Firm Values (People & Process)

  • Training & Mentorship: Actively participate in the in-house training program. For senior roles, assist in the training and development of new Advocate(s) and support staff to assure clients of the highest standards of advice and services.
