**Job Purpose**:
To provide expert legal advice, guidance, and representation in the context of arbitration proceedings. The role involves advising the company on arbitration laws, strategies, procedural matters, and assisting in the resolution of disputes outside of traditional court settings.
**Key Responsibilities**:
- **Arbitration Advice and Strategy Development**:
- Provide legal advice to clients regarding the arbitration process, applicable laws, and the potential for resolving disputes through arbitration.
- Develop strategies for approaching arbitration, including jurisdictional issues, selection of arbitrators, and enforcement of arbitration clauses.
- Assess the merits of a case and advise on the likely outcome of arbitration, taking into consideration relevant international treaties, national laws, and institutional rules.
- **Drafting and Reviewing Arbitration Agreements**:
- Assist clients in drafting and reviewing arbitration clauses and agreements within commercial contracts.
- Ensure arbitration clauses comply with relevant legal standards and best practices, and advise on the enforceability of such clauses in different jurisdictions.
- **Representation in Arbitration Proceedings**:
- Act as legal counsel representing clients in domestic and international arbitration proceedings.
- Prepare legal documents, submissions, and arguments to present before arbitrators.
- Coordinate the collection and presentation of evidence, including managing witnesses, expert reports, and other necessary documentation.
- **Management of Arbitration Processes**:
- Manage the procedural aspects of arbitration, including timelines, hearings, and procedural motions.
- Assist in appointing arbitrators, coordinating arbitration hearings, and addressing procedural challenges.
- **Legal Research and Analysis**:
- Conduct in-depth research on applicable arbitration laws, case law, and institutional rules.
- Keep abreast of global trends in arbitration, particularly concerning the enforceability of arbitral awards, jurisdictional issues, and emerging best practices.
- **Dispute Resolution and Settlement**:
- Explore settlement options during the arbitration process, facilitating negotiations or mediations where appropriate.
- Advise on the potential for a settlement or consent award in order to resolve disputes efficiently and cost-effectively.
- **Enforcement of Arbitral Awards**:
- Assist clients with the enforcement of arbitral awards in various jurisdictions.
- Advise on the recognition of foreign arbitral awards and assist in the process of seeking enforcement through local courts, where applicable.
- **Training and Development**:
- Provide training to internal teams and clients on arbitration-related matters, including the negotiation of arbitration clauses, dispute resolution strategies, and arbitration procedures.
- Keep stakeholders informed about the latest developments in arbitration law and practices.
- **Risk Management and Compliance**:
- Identify potential risks related to arbitration disputes and advise clients on ways to mitigate those risks.
- Ensure all arbitration processes comply with relevant legal, regulatory, and ethical standards.
**Qualifications**:
- **Education**:
- A law degree (LLB) from a recognized institution.
- Additional qualifications such as a Master's degree (LLM).
- **Experience**:
- A minimum of 2 years of experience in arbitration, with a strong track record of managing or advising on arbitration cases, preferably in [commercial, investment, construction, or a specific field of arbitration].
- Proven expertise in drafting and negotiating arbitration clauses and agreements.
Pay: ₹15,000.00 - ₹20,000.00 per month
