Job Title: Area Litigation Manager

About the Role:

The successful candidate will be responsible for preparing case notes, proposing strategic legal actions, and referring cases to advocates for various legal proceedings.

Key Responsibilities:
  • Cases Management: Prepare detailed case notes, identifying key issues and potential strategies for resolution.
  • Notice Drafting: Craft high-quality S 138 Notices that effectively communicate with borrowers.
  • Collaboration: Work closely with the collections team to develop time-bound and cost-effective legal action plans.
  • Asset Recovery: Reduce gross non-performing assets and identify customer details for recovery actions.
  • Research and Updates: Conduct thorough research on cases and share regular updates with teams on the latest developments in the legal field and emerging trends.
  • Legal Watch: Monitor all matters filed by or against the organization in Regional High Courts, District or Session Courts.
  • Demand Notices: Draft, vet, and approve demand-cum-termination notices, statements of claim, replies, and rejoinders, winding up petitions or any other Petition Reply.
  • Arbitration and Court Proceedings: Attend arbitration hearings and court proceedings, interact with advocates, and have regular meetings to provide instructions and further plan actions.
  • Tracking and Record Keeping: Track legal matters and circulate within the department for updating records for the respective region.
  • Compliance: Adhere to all legal compliances for recovery of dues.
  • Execution Orders: Procure disclosure orders, summons, warrants, attachment on property orders through execution proceeding under Order 21 of civil procedure code.
  • Order Execution: Ensure effective execution of said orders.
  • Response to Notices: Reply to notices received from advocates and/or borrowers within predetermined timelines.
  • Policies Compliance: Ensure compliance with policies when contacting customers for loan recovery.
  • Matter Escalation: Escalate all critical matters to reporting authority for any deviations or discrepancies.
  • Correspondence: Ensure that all written correspondence complies with policies in terms of verbiage and frequency of contact.
Requirements:
  • Self-Assessment: Self-assess and plan learning needs required for development in the current role.
  • Feedback and Reporting: Reach out to the Regional Collections Manager or HR for performance feedback and appraisals.
  • Performance Records: Ensure performance records and MIS are prepared periodically and shared with regional collections manager.
  • Appraisal Submission: Submit self-performance appraisals within timelines.
  • Feedback Discussions: Complete periodic feedback discussions with regional collections manager on time.
  • Learning Programs: Complete assigned learning programs within timelines.
