Right Advisors Private Limited | FEMA Controller

The ideal candidate is a detail-oriented individual who will oversee the company's FEMA rules and regulations. Will be responsible for maintaining all procedures and controls related with FEMA.
Understanding FEMA Regulations:
o In-depth knowledge of the Foreign Exchange Management Act, 1999, and related notifications, circulars, and amendments.
· Monitoring Transactions:
o Reviewing cross-border transactions to ensure they comply with FEMA provisions.
o Identifying and reporting any potential breaches or irregularities.
· Risk Management:
o Identifying risks related to non-compliance with FEMA.
o Implementing internal controls and checks to mitigate such risks.
· Record Keeping & Reporting:
o Ensuring proper documentation of foreign exchange transactions.
o Filing reports with the Reserve Bank of India (RBI) and other relevant authorities.
Key Responsibilities
1. Transaction Monitoring and Reporting:
o Review of transactions involving foreign exchange.
o Ensure compliance with reporting requirements (RBI forms, returns, etc.).
2. Documentation and Record-Keeping:
o Maintain accurate records of foreign exchange transactions.
o Ensure that all required documents (e.g., contracts, invoices, remittance records) are properly filed.
3. Advisory and Guidance:
o Advise the company on the legal implications of foreign transactions.
o Guide the organization in structuring foreign investments, borrowings, and remittances in accordance with FEMA.
4. Regulatory Compliance:
o Ensure the organization complies with annual limits on foreign remittances (e.g., under Liberalized Remittance Scheme).
o Verify that foreign borrowings and investments are within permissible limits under FEMA.
5. Risk Identification and Mitigation:
o Identify any potential risks or violations that could lead to legal repercussions.
o Implement corrective actions and internal controls to mitigate such risks.
6. Training and Awareness:
o Conduct training sessions for employees on FEMA compliance.
o Stay updated with changes in FEMA regulations and ensure the organization remains compliant.
