Job Description

Job Summary

Ensure to reduce the Bank's litigation portfolio by proper monitoring of cases, resolution of cases through legal advise,use of right Counsel and mediation.
Ensure adequate loan documentation at all times and proper drafting of Legal Agreements and perfection.
Duties & Responsibilities

§  Ensure cost consciousness and savings in all negotiations for settlement out of court or payment of Solicitors fees.

§  Make recommendations to Management for matters to be resolved amicably, where applicable.

§  Effective and proactive litigation portfolio management.

§  Ensure perfection of securities and proper Loan Documentation.

§  Deputizing for the Head, Legal Services where necessary in meetings and communications with members of EXCO.

§  Cooordinating the returns and monitoring of Perfectible Collateral deferrals with the Risk Management Department.

§  Preparation and defence of the Departmental Budget and ensuring regular monitoring of the Budget to ensure cost consciousness managing the resources allocated to the Department.

§  Monitoring of team members to ensure policy and procedures of the Bank and the Standard Operating procedure of the Department are adhered to.

§  Assisting with staff recruitment and performance evaluation.

§  Liaising with the Service Assurance Department to update the Standard Operating procedure of the Department as may be required.

§  Monitoring of the performance of team members to ensure KPIS are delivered within set timelines.

§  Provide feedback to team members, coaching and counselling towards achieving improved performance.

§  Ensure that Litigation and Garnishee matters are properly attended to protect the Bank's position,


§   Attend to challenges on  legal related AMCON matters to ensure proper resolution of legal matters with AMCON.


§  Supervision of the work of Legal Officers and providing direction and guidance on challenges faced with internal Customers and Solicitors.

§  Preparation/publishing of an all-encompassing checklist for securities (Updating at regular intervals).

§  Representation of the department in Management meetings to advise on legal issues arising at such meetings where necessary.

§  Review of Title and other transaction documents and advising the business on the suitability of same.

§  Drafting and Review of various Agreements.

§  Liaising with external Solicitors on perfection and litigation matters to resolve issues that may arise from time to time.

§  Review of credit documentation on STAR with a view to ensuring due diligence and compliance with the approval for the grant of the facilities.
§  Providing transactional support and advisory services to Branches and Head Office Departments on various issues.
§  Liaising with the external Solicitors for the perfection of the Bank’s Deed of Assignments and resolving issues that arise in the process.
§  Legal representation of the Bank in business meetings and conference calls with User units and Counterparties to negotiate terms of the contract with counterparties and advising on resolution of areas of conflict.
§  Providing transactional support and advisory services to Branches and Head Office Departments on various issue
§  Review of laws (including Bills, Acts, Bye-laws, Circulars, Regulations of relevant authorities, etc.) particularly those affecting the operation of the Bank and bringing them to the attention of Management
§  Providing legal advice/opinion on legal issues affecting the Bank’s operations
§  Review and resolution of Legal issues forwarded by branches, Head Office Departments.
§  Liaising with external Solicitors with a view to agreeing on a strategy for handling Banks litigation cases.
§  Review of Court processes and reviewing recommendations on the appointment of external Solicitors, payment of professional fees to the Solicitor, commencing out of court settlement or pursuing the litigation, etc and providing the necessary guidance/ approvals.
    Monitoring court cases and attending court sessions as much as possible, especially for high profile cases.
Requirements

Qualification-

§  Minimum education level –LL.B, B.L from a recognized University.

Experience-

·         12-14 years

Job Knowledge

  • Knowledge of the appropriate legal authorities for litigation for advice on legal matters, good skills in vetting and drafting of legal documentations  ;
  • Strong background knowledge in legal practice and proven ability to negotiate complex transactions and lead successful teams. 

·       Skills/Competencies

  •   Ability to review court processes and draft legal documents and vet Agreements.at entry level of legal practice with a good legal background;
  • Keen, conscientious, with a friendly disposition
  • An efficient and reliable person can work alone or as part of a team.
  • Can work well under extreme pressure and remain calm with the ability to prioritize.
  • A proactive leader with ability to liaise with colleagues at all levels, providing support and motivation.
  • Personable and adaptable individual with excellent communication, interpersonal and organizational skills
  • An analytical thinker, effective communicator together with a capacity to interpret and assimilate large volumes of complex information and construct cogent arguments.
