Role Description:

This is a full-time role for a Litigation Head at Moneyboxx Finance Limited. The Litigation Head will be responsible for leading the organization's comprehensive litigation strategy across its financial services business. This involves managing complex litigation matters, ensuring stringent regulatory compliance, and robustly protecting the company's interests across all legal proceedings.

Key Responsibilities:

- Develop and implement comprehensive and effective litigation strategies across all product verticals of the company.

- Oversee a diverse portfolio of cases, including recovery proceedings, customer disputes, regulatory actions, and commercial litigation.

- Manage specialized proceedings under the SARFAESI Act, DRT/DRAT filings, Section 138 cases, arbitration proceedings, and insolvency matters.

- Represent the company in high-stakes litigation and settlement negotiations, ensuring optimal outcomes.

- Oversee legal proceedings for mortgage enforcement, property possession, and auction processes.

- Develop specialized litigation approaches for different asset classes, including residential properties, commercial real estate, and MSME assets, as needed.

- Provide a strong litigation perspective to compliance initiatives, ensuring alignment with RBI, SEBI, and other relevant regulatory frameworks.

- Manage and coordinate responses to regulatory notices, inquiries, and show-cause proceedings.

- Keep senior management comprehensively informed about litigation-related regulatory developments and their potential business impact.

- Represent the company effectively before regulatory authorities during hearings and proceedings.

- Build, maintain, and manage strong relationships with external law firms and litigation counsel.

- Negotiate favorable fee arrangements with external counsel to optimize litigation costs.

- Develop detailed litigation budgets and meticulously monitor expenses against forecasts.

- Develop and implement litigation avoidance strategies through proactive compliance measures and legal risk assessment.

Required Qualifications:

Experience:

- Extensive experience in legal practice, with a substantial portion focused on litigation for financial services or NBFCs.

- Proven expertise in managing diverse litigation portfolios, including recovery, commercial, and regulatory matters.

- In-depth knowledge and hands-on experience with the SARFAESI Act, DRT/DRAT, Section 138 of the Negotiable Instruments Act, arbitration, and insolvency proceedings.

- Strong understanding of relevant regulatory frameworks from RBI and SEBI.

- Demonstrated ability to develop and execute effective litigation strategies.

- Excellent negotiation and representation skills.

- Strong analytical skills with the ability to assess legal risks and propose mitigation strategies.

- Exceptional communication and interpersonal skills to manage relationships with internal stakeholders and external counsel.

- Ability to work independently and manage multiple complex cases simultaneously.

- Admission to the Bar Council of India.
