Job Title: Legal Associate

Role Summary

The primary objective of this role is to provide support to the business by assisting in collections through legal means.

  • Identify matters for filing 138, SARFAESI, and other legal actions in consultation with senior officials.
  • Handle all legal matters related to debt recovery through SARFAESI action.
  • Assist in planning strategies and procedures to be followed in debt recovery and maintain a legal MIS for the assigned area, RBI MIS while providing quarterly reports on legal recovery.
  • Attend arbitration, section 9, execution, court receiver meetings, court receiver execution, and help draft section SARFAESI notices, possession, and sale notices, section 9 application, arbitration claim petition, suit for redemption of mortgage.
  • Handle all legal, SARFAESI, and compliance matters of the organization and coordinate with external vendors/agencies for the execution of different stages of SARFAESI Act.
  • Maintain and safeguard collaterals that are in the organization's possession post surrender or repossession after due adherence of norms under SARFAESI Act.
  • Coordinate with enforcement agencies and local police while taking physical possession of mortgaged property and ensure effective steps are taken in furtherance of the cases to get them resolved within the legal framework as advised.
  • Keep abreast of all latest developments/trends in local law/best practices with respect to collections, security creation, and loan documentation.
