We are seeking a seasoned Senior Legal Expert to join our team as a Litigation Recovery Specialist at Triangulas HR Solutions LLP.

Job Description:
  • Key Responsibilities:
    • Review and update policies related to litigation, ensuring compliance with relevant laws and regulations.
    • Draft and review legal documents, notices, objections, and responses in accordance with established procedures.
    • Proactively engage in reducing Non-Performing Assets (NPAs), lessening litigation, and enhancing recovery through effective strategy and communication.
    • Advise regional teams on changes in recovery laws, collaborating with corporate managers and the Head of Legal.
    • Liaise with Anti-Money Laundering (AML), Asset Liability Management (ALM), and Risk and Compliance Management (RCM) teams on actionable legal matters.
    • Coordinate with these teams to devise suitable strategies for resolving litigations on a case-by-case basis.
    • Maintain accurate records of litigations, monitor progress, and advise regions on further steps to be taken based on immediate hearing dates.
  • Additional Responsibilities:
    • Review the Litigation Management Information System (MIS) and follow up with regions for timely updates.
    • Ensure prompt handling of cases by panel advocates through regions.
    • Track and review the performance of legal vendors, including the renewal of service agreements.
    • Monitor and maintain trackers of advocate and vendor bills, submitting them to finance for clearance.
    • Track NPA cases and initiate alternative recovery measures.
    • Assist regional legal teams in invoking measures under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest (SARFAESI) Act, including tracking issuance and service of 13(2) notices, section 13(4), section 14 actions, and taking possession and sale of secured assets.

Requirements:

  • Qualifications:
    • A graduate degree in Law from a recognized university.
    • At least 10 years of experience in the legal departments of banks or financial institutions.
    • In-depth understanding of recovery matters through courts, SARFAESI action, bankruptcy proceedings, Lok Adalat, Arbitration, National Company Law Tribunal (NCLT), and Section 138 of the Negotiable Instruments Act/Promissory Note Service (PSS) Act.
  • Skills:
    • Drafting and communication skills.
    • Preparation of presentations (PPTs) on litigation progress.
    • Regulatory guidelines on recovery and appointment of recovery agents.

Estimated Salary:

₹1,200,000 - ₹1,800,000 per annum
