Job Purpose: To provide legal counsel, legal project management and daily support for collection litigation in India, for Caterpillar Financial Services India Private Ltd (Caterpillar Inc.’s wholly owned finance company operating in India).
Job Duties/Responsibilities: The job will be a short-term contract role (11 months tenure), which is eligible for renewal depending on performance and legal needs of the company. This attorney’s practice will focus primarily on support for collection and recovery-related litigation for Caterpillar Financial Services India Private Ltd. and will report to a senior attorney. The attorney will work directly with outside counsel and the business, including management.

Duties and responsibilities include:

- Managing legal collection litigation and pre-litigation cases by and against the company, including but not limited to arbitrations, criminal litigation, police investigations, recovery matters, customer disputes, and police complaints.
- Updating of processes and regularly facilitating recovery activity as to equipment.
- Providing daily oversight of outside counsel tasks and vendor invoice review.
- Maintaining excellent relationships with internal clients, including Collection Managers and the Collection team.
- Establishing processes related to and facilitating efficient transfer of regular updates and information between the business, internal legal, and outside counsel.
- Advising, appearing, and representing the company in conciliation proceedings/ mediation along with the outside counsel before the relevant authorities.
- Managing end to end litigation matters filed for and against the company.
- Conducting research and coordinating trainings to ensure legal and regulatory issues impacting the collection and recovery efforts are delivered to stakeholders.
- Preparing replies to the complaints and Drafting affidavits, written statement etc for consumer litigation cases in coordination with the Outside Counsel.
- Maintaining MIS of litigation matters, following up with outside counsel, and keeping stakeholders updated in systems or manner requested.
- Ensuring outside counsel and internal customers abide by the stated policies and procedures of the company, as well as the enterprise values statements.

Educational Qualifications and Skills:

- Law degree from a reputed university with strong academic record
- Proficient in the use of Microsoft products, including Excel, Outlook, Word, and Powerpoint
- Excellent research and issue-spotting skills
- Experience with collection, repossession activity related to movable security, and consumer litigation management
- Ability to handle large caseload with little oversight
- Strong understanding of legal concepts, analytical skills, and willingness to resolve issues
- Works as a team player and has a ‘can-do’ attitude
- Experience in handling and coordinating bulk litigations before various courts or forums
- Exposure in managing recoveries in secured and unsecured scenarios, arbitration and court situations, and with consumer protection claims, criminal litigation and general litigation
- Experience in drafting and vetting of various legal and commercial documents such as writs, agreements, memorandum of appeals, complaints, notices, affidavits, deeds, written statements, general pleadings, legal communications and contracts
- Experience in coordinating with advocates, law officers, court staff, police and law enforcement agencies
