Job Summary: The FEMA Compliance Specialist is responsible for ensuring adherence to the Foreign Exchange Management Act (FEMA) regulations concerning Overseas Direct Investment (ODI), Foreign Direct Investment (FDI), and export transactions. This role involves interpreting FEMA regulations, managing compliance processes, and providing guidance on regulatory matters related to cross-border investments and international transactions including share allotments and related filings
Key Responsibilities:
Regulatory Compliance:
Ensure compliance with FEMA regulations related to ODI, FDI, and export transactions.
Monitor changes in FEMA guidelines and update internal policies and procedures accordingly.
Review and process documentation related to ODI and FDI transactions to ensure adherence to regulatory requirements.
Manage share allotment / transfers to/from NR and related filings like FCGPR
Overseas Direct Investment (ODI):
Guide and assist in compliance with FEMA rules for ODI, including approvals and reporting requirements.
Prepare and file necessary reports and documentation with the Reserve Bank of India (RBI) and other relevant authorities.
Address queries and provide support regarding ODI transactions, including investment proposals and regulatory updates.
Foreign Direct Investment (FDI):
Facilitate and manage compliance processes for FDI, including documentation, approvals, and reporting.
Liaise with foreign regulatory bodies to ensure smooth processing of FDI transactions.
Review and analyze FDI applications to ensure they meet FEMA guidelines and other statutory requirements.
Export Management:
Ensure compliance with FEMA regulations governing export transactions, including repatriation of foreign exchange earnings.
Assist in the preparation of export-related documents and reports required by regulatory authorities.
Address compliance issues related to export activities and provide solutions to ensure adherence to regulations.
Advisory and Support:
Provide expert advice on FEMA-related matters to internal teams, clients, and stakeholders.
Conduct training sessions and workshops on FEMA compliance and regulatory changes.
Assist in resolving complex compliance issues and provide strategic guidance on FEMA-related matters.
Reporting and Documentation:
Prepare and submit accurate reports to regulatory authorities, including RBI and Ministry of Commerce.
Maintain detailed records of all ODI, FDI, and export transactions, ensuring accuracy and completeness.
Ensure timely and accurate submission of statutory reports and filings.
Audit and Review:
Conduct internal audits to ensure compliance with FEMA regulations and identify areas for improvement.
Assist in external audits and inspections by regulatory authorities.
Implement corrective actions based on audit findings and regulatory feedback.
Qualifications:
Education: Bachelor’s degree in Finance, Accounting, Business Administration, Law, or a related field. Master’s degree or professional certification in Finance or Compliance is a plus.
Knowledge & Experience: 8 to 15 years of experience in handling FEMA compliance, ODI, FDI, and export regulations. Experience with RBI or Tax or Company’s Act Compliances is highly desirable.
