Role & responsibilities

Roles:

  • Legal Advisors/Consultants:

  • Provide legal advice on GST issues and represent clients in court or before tax authorities.

  • Analyze the legal aspects of GST laws and regulations, including their application to clients cases.

  • GST Litigation Lawyer/Advocate:

  • Represent clients in GST-related cases before the GST authorities, appellate tribunals, or courts.

  • Draft and file appeals, petitions, and legal documents.

  • GST Dispute Resolution Officer:

  • Facilitate the resolution of disputes between taxpayers and tax authorities.

  • Mediate and negotiate to resolve GST disputes at an early stage, before escalation to higher courts.

Responsibilities:

  • Litigation Strategy:

  • Develop and implement strategies for defending clients in litigation related to GST, including tax assessments, penalties, and refund issues.

  • Case Preparation and Filing:

  • Prepare necessary legal documents, including petitions, appeals, and written submissions.

  • File cases with the relevant GST authorities, such as the GST Appellate Tribunal, High Courts, or Supreme Court.

  • Representation and Advocacy:

  • Represent clients in hearings before the GST authorities or judicial bodies, providing arguments and presenting evidence.

  • Appeals Process:

  • Handle the appeal process when clients disagree with GST assessments or other decisions made by tax authorities.

  • Settlement Negotiations:

  • Engage in settlement discussions or negotiations with the tax department to resolve disputes without going to court.

Preferred candidate profile

  • Educational Qualifications:
  • Law Degree (LLB) from a recognized institution.
  • Postgraduate qualifications in Taxation or a related field (optional but preferred).
  • Additional certifications in GST or Indirect Tax (such as CA, CMA, or CS) will be advantageous.
  • Experience:
  • 510 years of experience in handling GST litigation matters.
  • Prior experience in representing clients in tax-related litigation before authorities, tribunals, or courts.
  • Knowledge of legal procedures related to GST disputes, including appeal processes, hearings, and settlements.
  • Skills:
  • Strong legal and analytical skills: Ability to interpret complex legal texts, analyze case facts, and build solid arguments for litigation.
  • Deep understanding of GST laws and their practical application in disputes and litigation.
  • Excellent communication skills, both written and verbal, to effectively present cases and communicate with clients and authorities.
  • Negotiation skills for settlements and dispute resolution.
  • Attention to detail in preparing legal documents, notices, and appeals.
  • Familiarity with case law, GST circulars, and notifications related to indirect taxes.
