Key Responsibilities:


Trademarks:

- Conduct comprehensive trademark searches in India and international jurisdictions.

- Provide strategic advice on the registrability and use of trademarks, along with detailed risk assessments.

- Assist in product launches, advising on associated commercial risks and suggesting risk mitigation strategies.

- Draft and respond to Examination Reports, Notices of Opposition, counterstatements, and affidavits in opposition or support.

- Represent at Show Cause Hearings and ensure timely renewal of trademarks.

- Assist with branding and coining trademarks.

- Evaluate and advise on international trademark office actions and oppositions.

- Review trade dress and packaging for registrability and usability across jurisdictions.

- Draft Cease and Desist notices and advise on trademark misuse or disparagement.

- Conduct due diligence for trademarks, advising on brand viability.

- Draft, review, and negotiate agreements related to trademarks, copyrights, and patents, including assignments and licenses.

- Maintain and update the Trademarks Database, providing quarterly updates.

- Work with legal teams on all trademark and copyright litigation.


Copyright:

- Draft and review disclaimers, privacy policies, and terms of use for digital platforms.

- Advise on content, videos, advertisements, and social media posts for copyright compliance.

- Handle legal matters related to domain names and review online content disclaimers.

- Draft and review patient information leaflets and consent letters.


Commercial Contracts:

- Draft, review, and negotiate trademark assignments, license agreements, CDA/NDA, and service agreements.

- Provide IP clause advice for commercial contracts across different territories.

- Negotiate commercial agreements, such as supply, distribution, service, and material transfer agreements.

- Flag potential risks to the business team and ensure internal approvals are obtained before finalizing agreements.


Skills Required:

- Expertise in intellectual property law, specifically trademarks and copyrights.

- Strong experience in contract drafting, negotiation, and risk assessment.

- Excellent communication and stakeholder management skills.

- Knowledge of IP litigation procedures and international IP regulations.
